TERMS AND CONDITIONS

Purpose and Organization

These contractual Terms and Conditions are intended to establish the terms and conditions governing the provision of organized travel services by VOLUNTURISMO UNIPESSOAL LDA, headquartered in Cabo Verde, São Vicente, Nossa Senhora da Luz - Pedra Rolada, registered under Tax ID (NIF) 280892802 and Registration/Enrollment 280892802/4597520190521.

The organization of tours is the responsibility of VOLUNTURISMO UNIPESSOAL LDA, hereinafter referred to in these Terms and Conditions as "the Company."

These Terms and Conditions are complemented by the travel program in which the Client registers, which constitutes the specific conditions of participation in the trip.

By contracting with the Company, the Client acknowledges and accepts all terms and conditions set forth herein.

Liability

VOLUNTURISMO UNIPESSOAL LDA is not responsible for flight delays, cancellations, or overbooking situations.

The Company may support the client, intercede with the airline, and assist in finding alternatives; however, it cannot provide refunds nor assume responsibility for any unforeseen events related to flights.

Registrations and Payments

The Client’s registration and that of their companions is only valid after full or partial payment of the registration fee and completion of the form available on the Agency’s website. The Client must settle payment up to 30 days before the departure date or according to instructions given by email, which shall prevail if applicable.

If registration occurs 30 days or less before the trip start date, full payment must be made at the time of registration, subject to confirmation of all service reservations. The Company reserves the right to cancel any registration for which payment has not been made under the conditions mentioned.

By registering, the Client undertakes:

To have read and accepted these Terms and Conditions of participation, as well as the travel program in which the Client is enrolled, which constitutes the specific conditions of participation in the trip.
That they are in adequate health condition for the trip in which they are enrolled and accept the nature of the trip, including risks arising from the impossibility of immediate access to medical assistance.
That they are aware of the type of physical, cultural, and psychological demands that the trip may involve and which may lead to unforeseen situations.

Minimum Age

The minimum age to participate in the Company’s trips is 18 years for solo travelers. Underage participants may only travel accompanied by an adult responsible person, duly proven by proper documentation and in accordance with applicable legislation.

Accommodation

The Company provides accommodation in local lodgings, guesthouses, and hotels according to client preferences and ongoing programs. Room type and sharing depend on the subscribed service. Clients may request single rooms, subject to payment of an additional fee applied by the Company. Clients registering individually without opting for a single supplement will be grouped by gender whenever possible.

Documentation

It is the Client’s responsibility to have all personal and family documentation (identity card, passport, military documents, minor authorizations, visas, vaccination certificates, or others as required) necessary for the trip. The Agency declines any responsibility for visa refusal or denial of entry to a foreign country; in such cases, the conditions under the “Cancellations” clause apply, and any resulting costs are the sole responsibility of the Client.

Use of Client Information

The Client expressly consents that all information, including personal data, provided in relation to their trip may be transmitted to government authorities for border control and air travel or other security purposes.

The Client also expressly consents that all information, including personal data, may be shared with local partners of VOLUNTURISMO UNIPESSOAL LDA to carry out the travel program, including preferences, dietary requirements, specific health information, or others.

Date Changes

A Client registered for a trip may not transfer their registration to another trip or to the same trip with a different departure date without the express consent of the Company. If such a change is possible, it may be subject to fees and charges under the “Cancellations” clause.

Non-Transferability / Assignment of Registration

Trips are non-transferable, and the Client may not transfer their registration, substituting another person.

The Client may, however, assign their registration to another person who meets all the requirements for the trip, provided they inform the Agency at least 60 days before departure and provided that service providers accept the substitution. Otherwise, it will be considered that the Client has canceled the trip.

If the Client transfers their registration to someone of a different gender, they may be subject to a single-room supplement or similar costs if grouping with another participant of the same gender is not possible.

Both the assignor and assignee are jointly responsible for payment of the trip price and any additional costs incurred.

Changes

For justified reasons beyond its control, the Company may change the order of itineraries, modify schedules, or substitute accommodations and transport with those of similar category. If unforeseen circumstances force the suspension of the trip, the Client will be entitled to a refund of amounts paid.

Impossibility of Fulfillment

If due to reasons not attributable to the Company, it becomes impossible to provide any essential service included in the program, the Client has the right to cancel the trip and be immediately refunded, or alternatively, accept a modification with possible price adjustment.

If the trip is canceled for reasons not attributable to the Company, the Client may also opt to participate at a later available date.

Minimum Participants and Program Cancellation by the Company

Each program specifies a minimum number of participants. If this number is not reached, the Company may cancel the trip or suggest it be operated by another agency under the same conditions. In such cases, the participant may decide to continue or decline, with full refund of amounts paid. The Agency bears no further responsibility for the cancellation.

Postponements and Cancellations

If the Client or a companion cancels the trip up to 30 days before the program start date, they forfeit the confirmation fee paid, which is non-refundable. If full payment has already been made, the Company will issue a voucher (excluding the confirmation fee) for future use, valid up to 12 months.

If cancellation occurs 30 days or less before the program start date, the Client forfeits the total trip cost. The Client also forfeits payment for any additional non-refundable services requested.

In case of postponements more than 30 days before the trip, the Client must pay costs related to flight changes with the airline and other possible non-refundable costs (lodging, guides, transport, experiences). Cancellations less than 30 days before departure are not eligible for refund or voucher.

Refunds

Before the trip, refund requests are subject to the terms under “Postponements and Cancellations.”

After the trip begins, no refunds will be granted for unused services. Services not provided due to reasons not attributable to the Company, and which cannot be replaced by equivalent services, entitle the Client to a refund of the difference between the planned and delivered services.

Price Changes

Prices in the program are based on service costs, exchange rates, and taxes in force at the time of publication. They may change due to variations in transport or fuel costs, duties, taxes, exchange rate fluctuations, inflation, or commercial strategy.

Clients in the registration process who have not yet made any payments will be informed of changes and may decide whether to proceed under the new conditions.

Clients who have already paid a deposit or installment will not be affected by changes to previously agreed conditions.

Taxes and Fees

All prices on the Agency’s website include VAT at the applicable rate.

Since VOLUNTURISMO UNIPESSOAL LDA is based in Cabo Verde, payment must be made through the SISP (Easylink) platform, which ensures funds are deposited directly into the Company’s account, avoiding double taxation and complying with tax regulations. This process has associated costs, disclosed in brochures and during payment.

Current additional charges:

2.5% – International transaction fee (retained by SISP during payment processing)

4% – Special Unified Tax (TEU) for companies under REMPE (micro and small enterprises)

Total increase: 6.5% as of the date of these Terms & Conditions update

Insurance

It is the Client’s responsibility to decide whether to purchase appropriate travel insurance for the period, destination, and activities. Failure to subscribe or purchasing inadequate insurance exempts the Company and partners from liability.

Complaints

Complaints must be submitted in writing to palopianos.pt@gmail.com. Only complaints submitted in writing within 20 days after the service delivery will be considered. Complaints must also have been reported to service providers (hotels, guides, local agents, etc.) during the trip, with supporting documentation provided.

Luggage

The Company is not responsible for Client luggage during travel or lodging. Clients may take out insurance and should exercise normal care when luggage is handled by service providers. In case of theft, damage, or loss, the Client must immediately file a written complaint with the service provider.

Note

These Terms and Conditions are complemented by the travel program in which the Client and companions enroll, which constitute the specific conditions of participation in the trip. They may also be supplemented by other specific conditions provided to the Client at registration or otherwise agreed between the parties.
